In the Daniel Penny Case, The Damage Has Already Been Done

December 7, 2024–Regardless of what happens next in the Daniel Penny case, the damage has already been done.

The message has gone out to all men, especially White men, and it’s been received:

Do nothing.

Don’t step up or step in.

Do NOT intervene.

Do NOT get involved.

Regardless of the situation, you will be held at fault.

Your life will be destroyed. You will be charged, prosecuted and sued.

It’s just not worth it.

Better to stand back, better still to ignore the situation completely until you can be somewhere else.

What happened to Daniel Penny makes it crystal clear how modern “progressive” society will treat men like Penny who try to do the right thing.

Friday, the judge dismissed the manslaughter charge against Penny when the jury was unable to reach a unanimous verdict. The judge then ordered the jury to continue deliberating Monday on the lesser charge of criminally negligent homicide.

Penny was charged with both manslaughter and negligent homicide following the death of Jordan Neely in May, 2023. Neely was acting erratically and making allegedly threatening statements on the subway when Penny, a Marine Veteran, subdued him. Neely had a pulse reported by responders after Penny released him, but died on the scene shortly thereafter. Responders declined to perform mouth to mouth resuscitation due to Neely’s appearance and fears they might contract hepatitis or HIV.

Despite those who were actually in the subway car at the time lauding Penny as a hero, NYC DA Alvin Bragg, Police Commissioner Jessica Tisch and Assistant DA Dafna Yoran didn’t see it that way. When police initially interviewed Penny, they didn’t bother telling him Neely was dead. The interviewers approached Penny as friends, making small talk and attempting to bond over both of them being Marines. In reality, they were gathering evidence that would later be used against Penny.

As a side note, any attorney worth their salt will tell you to NEVER talk to the cops. There are tons of videos on YouTube driving this point home, and I’ll link to a few of them when I put this on Substack.

DA Bragg, who reduced 60% of felony charges in one recent year, chose to prosecute Penny aggressively. In contrast, Jordan Young, a 20 year old Black man who fatally stabbed a homeless man on the subway. He was released without bail, and all charges were ultimately dropped. Or how about those migrants who were also released without bond after beating up that NYC cop? Daniel Penny’s bond was $100,000, and had he been convicted of manslaughter he would have faced up to 15 years in prison.

Penny was quickly accused of being a racist and White Supremacist, despite him denying any racial motivation for his actions. Penny said that he felt compelled to step in because there were older women and children on the train “and they were terrified,” and for that he’s gotten death threats. Also, Neely’s long-lost father has now emerged from obscurity to sue Penny over his son’s death.

We’re not supposed to talk about how Neely’s father basically abandoned him years ago to struggle with mental illness, substance abuse and homelessness on his own. We’re also not supposed to talk about Neely’s 40+ arrests, including trying to kidnap a 7 year old girl (2015), pinching a 64 year old man in the face (2019) and, punching a 67 year old woman in the face (2021).

We're really not supposed to talk about how Penny’s prosecutor is Dafna Yoran, an Israel-born Jewish progressive lesbian with a penchant for “restorative justice,” married to a Peruvian BLM activist and artist, Ana De Orbegoso. Orbegoso’s art promotes social justice and racial equality (I guess—I don’t see it, but then again, I’m not a progressive Peruvian lesbian). In July of 2020, Orbegoso was part of a panel hosted by the Bruce museum, which was described by an event spokesperson as “Our artists and speakers are not only engaging with Black Lives Matter and other social change agents, they are the vanguard of the world that must be and will be equitable for all.“

Any guesses who Yoran voted for last month? Hint: almost certainly NOT Donald J. Trump.

Interestingly, during closing arguments in the trial, Orbegoso’s wife (Prosecutor Yoran) accused Penny of failing to recognize Neely’s “humanity,” saying “he (Penny) didn’t recognize that Jordan Neely was a person” and “he saw him as a person that needed to be eliminated.” Prosecutor Yoran continually dangled the race card throughout the trial, beginning with her opening statement. Her team allowed witnesses to refer to Penny as “the White man” and “murderer” during the trial, despite repeated objections from the defense, and Penny not being charged with a “hate crime.”

Even more interestingly, in 2019 Yoran gave a reduced sentence to a Black man who murdered an 86 year old Asian professor during an attempted robbery at an ATM. In her own words:

“This is, under the law, a felony murder, which is akin to intentional murder. However, when I first got the case, I took the time to learn about the defendant. It was a strong case, so it wasn’t about whodunnit. We knew immediately who did it, I could take it to trial that day and win it, but it wasn’t about that. It was that the more I learned about the defendant and his life and the circumstances…the things that one should take into account like the trauma of that individual, I really felt incredibly sorry for him, that he had gotten to that point in his life where he felt like there was no other choice for him but to commit this robbery.”

She lowered the initial charge of murder to manslaughter, for which he received 10 years under a “restorative justice” program.

Apparently, she didn’t take the time to get to know the surviving family and friends of the victim, or care about their circumstances and trauma. I guess to her and her Wifey-poo, Asian lives just don’t matter as much as Black lives. Or something.

There’s more video of her on the web, and let me just say this: sister’s got more issues than the magazine section in Barnes & Noble.

Here’s perhaps the most interesting thing of all: NYC Mayor Eric Adams has actively defended Penny, saying “those passengers were afraid,” and “You have someone [Penny] on that subway who was responding, doing what we should have done as a city." Adams has also said about Penny that “I think we've always asked New Yorkers, you see something, say something, do something,” and has been pushing for “more power for involuntary removal for those who can’t take care of themselves” because of their mental health issues.

Yes, this is the same Mayor who just dared people to “Cancel me because I’m going to protect the people of this city!” by working with President Trump and incoming border czar Tom Holman regarding the deportation of the illegal aliens. It’s also the same Mayor who didn’t say ‘no’ when he was asked if he’d consider joining the GOP.

Mayor Adams has been on the frontlines of the Biden/Harris Regime’s war on America for years now, and it’s opened his eyes to some cold, harsh realities. Chief among these is that if you speak Big-T Truths, your fellow Democrats will turn on you savagely. He’s seen what unrestricted immigration, copious freebies for “newcomers” and ultra-lax liberal prosecutors have done to his city, and he doesn’t like it. He’s not afraid that, as the Babylon Bee predicted, a Not Guilty verdict for Daniel Penny “Could Lead To Rampant Acts of Heroism”—just the opposite, in fact.

Eric Adams worries what New York AG Letitia James’ and DA Bragg’s rampant lawfare against Donald Trump has done to the business climate of his city. He worries about how he’s going to pay the bills for all those illegals, in the face of rising unhappiness from American citizens. He’s worried about spiraling crime rates, and growing police dissatisfaction.

Mayor Adams has to be worried what will happen when the unstable, the illegal and the undersocialized realize that the Daniel Penny’s of NYC have gotten the message and are standing down. It’s already starting, and it’s not pretty. It won’t end well for NYC—or any other Blue-run city with prosecutors like James, Bragg and Yoran.

We can still hope that Daniel Penny will be acquitted. We can hope that President Trump’s election will usher in a reversal of the rampant destruction and insanity we’ve been forced to endure these last few years. We can hope that Letitia James, Alvin Bragg, Dafna Yoran and their ilk will not just be brought to heel, but held accountable for their misdeeds and malfeasances.

Most of all, we need to hope that a new message goes out to all the potential Daniel Penny’s of the world:

We need you.

We need you to be men.

We’re with you, and when you step up to do the right thing,

We’ve got your back.
