January 14, 2025 – President Donald J. Trump (R) will return to the White House in just six days and failed special prosecutor Jack Smith resigned from his position on Friday; but on his way out Smith released a report claiming that Trump was guilty of actual crimes and that if he had been given a chance that he could have convicted Trump before a jury.
President-elect Trump slammed Smith for the release of the highly partisan report.
"To show you how desperate Deranged Jack Smith is, he released his Fake findings at 1:00 A.M. in the morning," said President Trump on his Truth Social account. "Did he say that the Unselect Committee illegally destroyed and deleted all of the evidence."
"Deranged Jack Smith was unable to successfully prosecute the Political Opponent of his "boss," Crooked Joe Biden, so he ends up writing yet another "Report" based on information that the Unselect Committee of Political Hacks and Thugs ILLEGALLY DESTROYED AND DELETED, because it showed how totally innocent I was, and how completely guilty Nancy Pelosi, and others, were," Trump added. "Jack is a lamebrain prosecutor who was unable to get his case tried before the Election, which I won in a landslide. THE VOTERS HAVE SPOKEN!!!"
Smith defended his investigations into President-elect Trump in a final report released publicly early Tuesday morning, saying his determinations were free from political interference and that, if permitted to proceed, his cases would have likely secured a conviction.
"The ultimate decision to bring charges against Mr. Trump was mine," Smith wrote in his farewell letter to Garland. "It is a decision I stand behind fully,"
Smith claimed that neither Garland or anyone else at the DOJ pushed him to prosecute Trump.
"To all who know me well, the claim from Mr. Trump that my decisions as a prosecutor were influenced or directed by the Biden administration or other political actors is, in a word, laughable," Smith claimed.
The 174 page report claims that Trump attempted to thwart Biden's inauguration and the transition of power.
"The throughline of all of Mr. Trump's criminal efforts was deceit-knowingly false claims of election fraud-and the evidence shows that Mr. Trump used these lies as a weapon to defeat a federal government function foundational to the United States' democratic process," Smith claimed.
Notably Smith does not name the members of Congress whom he claim were coordinating with Trump.
Some Democrats have blasted Garland for waiting too late to appoint Smith. Getting either case investigated and then brought before a jury ahead of the November 5 election ultimately proved to be a bridge too far.
Federal Judge Eileen Cannon ruled that Smith was illegally appointed by Biden Attorney General Merrick Garland when she dismissed Smith's case claiming that Trump knowingly mishandled classified documents.
Smith has dropped both of his prosecutions of Trump after Trump's re-election on November 5, because it is Justice Department policy that a DOJ investigation of a sitting president is unconstitutional.
Newsweek reports that Smith spent over $50 million in his failed investigations – money that could have been better spent securing the southern border, prosecuting drug traffickers, or removing the brush and undergrowth that is fueling the Los Angeles fires.
Republicans argue that Smith was appointed not to prosecute actual crimes; but to taint President Trump's reputation and influence the 2024 election. Whether Smith's mission was to put Trump and his supporters in prison or to make Trump unelectable he ultimately failed at both.
